I'm not going to pretend this is abstract anymore. The EU AI Act is not a draft. It's not a proposal. It's not a "might happen in a few years" scenario. It's law. Provisions are already in effect. And the big one — the high-risk system requirements that affect the vast majority of enterprise AI deployments — takes full effect in four months.
If your organization uses AI in any EU market, or if your AI systems affect EU citizens, this applies to you. And the penalties for getting it wrong are not symbolic.
The Timeline Is Real
Prohibited practices provisions took effect. Certain AI applications — social scoring systems, manipulative AI, real-time biometric identification in public spaces — are now banned outright.
General Purpose AI (GPAI) rules took effect. Providers of general-purpose AI models must meet transparency requirements, including documentation and copyright compliance.
High-risk system requirements take full effect. This is the big one. AI systems used in employment, credit scoring, critical infrastructure, education, and other high-risk domains must meet comprehensive requirements for risk management, data governance, documentation, human oversight, and accuracy.
Colorado AI Act takes effect. US-based organizations face domestic AI regulation as well, creating a multi-jurisdictional compliance challenge.
The fines are structured to hurt. Up to €35 million or 7% of global annual turnover for prohibited practices. Up to €15 million or 3% for other violations. For a company with $500 million in revenue, that's a potential $35 million fine — more than enough to be a board-level risk.
But here's what I think most organizations miss about the EU AI Act: it doesn't just require you to have policies. It requires you to demonstrate continuous compliance. Point-in-time assessments won't satisfy regulators. They want to see ongoing monitoring, traceable decision-making, and an audit trail that proves your governance isn't just documented but actively enforced.
What "High-Risk" Means for Enterprise AI
The "high-risk" classification is broader than most enterprise teams realize. It's not limited to life-or-death applications like medical devices or autonomous vehicles. It includes AI systems used in:
Employment and workforce management. AI tools that screen resumes, assess candidates, make promotion decisions, or monitor employee performance. If your HR team uses any AI in the hiring pipeline — including AI-powered sourcing tools, resume screeners, or interview analysis platforms — those are high-risk systems under the Act.
Access to financial services. AI systems used in credit scoring, loan decisions, or insurance underwriting. If your financial operations involve any AI-assisted decision-making about creditworthiness or risk assessment, those systems are in scope.
Critical infrastructure management. AI used to manage energy, transportation, water, or digital infrastructure. Enterprise IT teams using AI for network management, capacity planning, or automated incident response may find their tools classified here.
Education and vocational training. AI systems that assess students, determine admissions, or personalize learning pathways.
The requirements for high-risk systems are substantial: a risk management system, data quality and governance measures, technical documentation, record-keeping and logging, transparency and information to users, human oversight mechanisms, and requirements for accuracy, robustness, and cybersecurity.
Many enterprise AI deployments fall into these categories without teams realizing it. That HR tool that ranks candidates? High-risk. That financial model that scores loan applications? High-risk. That IT operations tool that makes automated infrastructure decisions? Potentially high-risk. The first step is knowing which of your AI systems fall into these categories — and you can't do that without a complete inventory.
Five Things You Need Before August
1. A complete AI inventory — including shadow AI
You cannot classify risk for systems you don't know about. And with the majority of employees adopting AI tools without IT oversight — Netskope found 47% access GenAI through personal, unmonitored accounts alone — there are almost certainly high-risk AI systems in your environment that nobody has assessed. 2. Risk classification for every AI system
Once you have the inventory, map each tool against the EU AI Act's risk categories. Which are prohibited? Which are high-risk? Which are limited risk? Which are minimal? This classification determines what requirements apply to each system and what evidence you need to produce.
3. Continuous monitoring and evaluation
The Act requires ongoing compliance, not annual audits. Your governance infrastructure needs to evaluate AI systems continuously — checking for policy violations, changes in data access, changes in model behavior, and new deployments that haven't been classified. 4. Documentation and immutable audit trails
Every governance decision must be traceable. When a regulator asks how you evaluated a specific AI system, you need to show the evaluation criteria, the result, who reviewed it, and what actions were taken. An immutable audit trail that logs every evaluation, every exception, and every override is not optional — it's a regulatory expectation.
5. Human oversight mechanisms
High-risk systems require documented human-in-the-loop processes. This means defining which AI decisions require human review, establishing escalation paths, and proving that humans have meaningful ability to override AI decisions. "A human approved this" isn't sufficient — you need to document how the human was informed, what information they had, and what authority they had to intervene.
